Pro Stage Bikini Terms and Conditions
These Terms and Conditions govern orders placed with Pro Stage Bikini. They explain how a contract is formed, how customised products are produced and paid for, and which rules apply to delivery, returns and defects.
1 Scope and contracting party
These Terms and Conditions apply to purchases from Pro Stage Bikini through the online shop and to orders placed through email, Instagram or another direct channel where these Terms and Conditions are incorporated into the order.
The contracting party is Pro Stage Bikini by O. Ohst-Savenkova, Olena Ohst-Savenkova, Fraumattenstrasse 5, 4105 Biel-Benken, Switzerland. Email: info@prostagebikini.ch. Telephone: +41 78 247 93 41. UID: CHE-422.718.220. Pro Stage Bikini is a Swiss sole proprietorship and is not registered for Swiss VAT.
A consumer is a natural person who purchases mainly for purposes outside a trade or profession. Mandatory consumer rights that apply in the customer’s country remain unaffected.
2 Products and product information
The shop offers made-to-measure and personalised competition wear, posing bikinis, Fit Model suits, Classic Physique Trunks, Bodybuilding Trunks, personalised robes, Ready to Ship products and standard accessories or merchandise.
Product photographs show the relevant design as accurately as possible. Screen settings, lighting, dye lots and the handmade application of crystals may cause minor differences in colour, placement or detail. Such minor differences do not constitute a defect if the product retains the agreed character and overall appearance.
An existing named design has a defined colour palette, crystal composition and overall look. The customer may select only the fit and construction options offered for that model. A completely new colour or crystal concept requires a separate Custom Design Request.
3 Configurator and customer information
The options shown in the relevant configurator form part of the order. Depending on the product, the customer may be asked to select a category, cup, bottom shape, coverage, fabric, connector or personalisation and to provide measurements, federation, approximate competition date, email address, Instagram username and comments. An Instagram username is required for made-to-measure competition wear so that Pro Stage Bikini can contact the customer and review photographs relevant to fit and the stage look.
The customer must check all selections and provide complete and accurate measurements and information. Measurements must be taken according to the measuring instructions linked in the configurator. Pro Stage Bikini may request updated measurements before production. A change in the customer’s body after measurements were supplied is not a product defect.
The customer must review the federation and category requirements that apply to the intended competition. Pro Stage Bikini considers the federation information supplied by the customer when preparing the order but does not guarantee acceptance by a federation, promoter or judging panel unless a specific requirement was confirmed in writing.
4 Order process and contract formation
Orders may be placed without creating a customer account. Before submitting an online order, the customer can review and correct the entered information. By using the final order button, the customer submits a binding offer to purchase the products in the basket and accepts these Terms and Conditions.
An automated order acknowledgement only confirms that the order was received. A contract is formed only when Pro Stage Bikini sends a personal written order confirmation or expressly accepts the order in another written message. Pro Stage Bikini may decline an order because of production capacity, an unrealistic competition date, incomplete information, an unavailable option or another reasonable production constraint.
If payment was authorised or collected before the order was accepted and Pro Stage Bikini declines the order, the amount will be released or refunded without undue delay.
5 Prices and payment
All shop prices are displayed in euros unless stated otherwise. The price shown for the configured product before checkout is the product price. Paid options are added automatically in the configurator. Shipping, import duties, import VAT, customs clearance fees and other destination-country charges are not included unless expressly shown.
As Pro Stage Bikini is not registered for Swiss VAT, Swiss VAT is not shown separately. The payment methods available for a particular order are displayed at checkout or stated in the order confirmation. These may include card payment, PayPal or bank transfer.
A €200 deposit applies exclusively to made-to-measure competition suits with crystals in the Bikini, Wellness, Figure and Women’s Physique categories, including Surprise Bikinis and fully custom crystal designs. The deposit reserves a production slot once the order has been personally confirmed and is credited toward the total price. The remaining balance must be paid before shipping. Fit Model suits, posing bikinis, men’s trunks and all other products are not offered with a deposit option; full payment applies. The payment procedure for these products is displayed at checkout or stated in the order confirmation.
Production starts only after the required payment and all information needed for production have been received. Pro Stage Bikini may pause production and extend the schedule if payment, measurements, approvals or requested information are late.
6 Consultation and custom design
Detailed consultation on colours, crystals, fit and measurements for a custom competition suit with crystals begins after the required €200 deposit has been received. Advice and visual proposals remain part of Pro Stage Bikini’s creative service and may not be copied or used to commission the same design from another supplier.
For a Surprise Bikini, Pro Stage Bikini discusses the customer’s category, stage look, preferences and excluded colours or styles before production. The final colour and design remain a surprise until delivery. Cup, coverage and connector options may still be selected in the configurator.
7 Production times and competition dates
Production times are estimates unless a specific delivery date is expressly confirmed in writing. Competition suits with crystals in the Bikini, Wellness, Figure and Women’s Physique categories require at least six weeks, depending on the design, season and production capacity. Booking 12 to 16 weeks before the competition is recommended.
Fit Model suits usually require 3 to 6 weeks, posing bikinis 3 to 5 weeks, men’s trunks approximately 3 weeks and personalised robes approximately one week. Ready to Ship products and standard accessories are normally dispatched within 7 days. Shipping time is additional to all production and dispatch periods.
The competition date helps Pro Stage Bikini plan production. It does not by itself create a guaranteed delivery date. If delivery by a particular date is essential, the customer must obtain express written confirmation before the contract is formed.
A competition suit with crystals required in less than six weeks is a Rush Order. Rush Orders are accepted only after personal written confirmation and subject to production capacity. A surcharge of 20% applies. Shipping time must also be taken into account. Entering an earlier competition date in the configurator does not automatically confirm acceptance of a Rush Order.
8 Pre stoning fitting service
For eligible competition suits with crystals, the customer may book a pre-stoning fitting service. The undecorated suit is sent to the customer before the crystals are applied so that the fit can be checked. The service costs €60 plus all related shipping charges and includes one alteration.
The customer must try on, check and return the suit within seven days after delivery and follow the provided hygiene and handling instructions. Delayed return or delayed feedback extends the production schedule. Additional alterations, changes of preference or corrections caused by inaccurate measurements may be charged separately.
9 Changes and cancellation of custom orders
After the contract is confirmed, requested changes are possible only if Pro Stage Bikini accepts them in writing. A change may affect the price and production time. Work completed before the change and materials that can no longer be used for the original order remain payable.
A customer may request cancellation of a made-to-measure or personalised order only while more than eight weeks remain before the stated competition date and before production has begun. Cancellation is effective only after written confirmation from Pro Stage Bikini. The reservation deposit, where applicable, and documented costs already incurred for consultation, reserved capacity, work or individually sourced materials may be retained to the extent permitted by law. Any remaining prepaid amount will be refunded.
Once production has begun, or when eight weeks or less remain before the stated competition date, the custom order cannot be cancelled. Mandatory rights in the event of non-performance or a defect remain unaffected.
10 Shipping delivery and customs
Pro Stage Bikini ships using a tracked service selected for the destination. The standard shipping charges are: Switzerland €9; Germany and EU countries €15; United Kingdom €20; Norway, Iceland, Serbia, Turkey and other countries in DHL’s European shipping zone outside the EU €25. Shipping is charged separately from the product price. Free shipping is not offered unless expressly stated for a promotion.
For shipping to the Americas, Asia, Africa, Oceania or other destinations not covered by the standard rates above, the shipping charge is calculated individually. Customers may pay for their product through the website or pay the €200 deposit where that option is available for a made-to-measure competition suit with crystals. No deposit option is available for Fit Model suits, posing bikinis, men’s trunks or other products.
Pro Stage Bikini will contact the customer personally to confirm the shipping cost. The agreed shipping charge may be invoiced separately. Payment of the product price or deposit does not mean that individually quoted shipping is included or free. If no shipping charge is collected at checkout for an individually quoted destination, it remains payable separately. Dispatch takes place only after the agreed shipping charge and any remaining product balance have been paid.
Unless a different arrangement is expressly stated in the shipping quotation or written order confirmation, the recipient is responsible for import duties, import VAT, customs charges, brokerage or clearance fees imposed by the destination country. Any such charges included in the quotation or invoice will be expressly identified. Customs processing may delay delivery and is outside Pro Stage Bikini’s control.
The customer must provide a complete and correct delivery address and monitor tracking information. If a parcel is returned because of an incorrect or incomplete address, refusal of delivery or failure to collect it, the customer must pay the documented return, customs and reshipping costs. Reshipping takes place after these costs have been paid.
For consumer orders, the risk of accidental loss or damage passes when the customer or a person designated by the customer, other than the carrier, receives the parcel. If the customer independently commissions a carrier that was not offered by Pro Stage Bikini, the risk passes when the parcel is handed to that carrier.
11 Returns for made to measure and personalised products
Stage suits, posing bikinis, Fit Model suits, Figure and Women’s Physique suits, Classic Physique Trunks, Bodybuilding Trunks, personalised robes and other products made to the customer’s measurements or specifications cannot be returned or exchanged because they are made specifically for the customer. This exclusion also applies to a configured product when the selected combination is produced only after the order.
This exclusion does not limit the customer’s rights if the product is defective, does not match the confirmed order or another mandatory legal remedy applies.
12 Returns for Ready to Ship and standard products
A Ready to Ship bikini that was not made to the customer’s measurements, and other eligible non-personalised products, may be returned if the customer sends an unequivocal return notice within 14 days after receipt. The customer must then return the product without undue delay and within any further period required by mandatory law.
A Ready to Ship bikini may only be tried on hygienically over the customer’s own underwear. It must be returned with its tags, original packaging and any hygiene protection supplied with the item intact. It must show no signs of wear, cosmetics, tanning products, deodorant, odour, washing, alteration or damage. For other products, handling must not go beyond what is reasonably necessary to inspect the nature, characteristics and fit of the item.
The customer bears the direct return shipping costs and any return-related import or customs costs unless the return is caused by a defect or incorrect delivery. The customer is responsible for an avoidable reduction in value caused by excessive handling. For a voluntary return under these Terms and Conditions, the refund is processed after the item has been received and inspected. Where mandatory consumer law requires an earlier refund upon proof of return, that rule applies.
Where mandatory law requires reimbursement of the least expensive standard outbound delivery charge, that charge will be reimbursed. Additional costs for express or premium delivery are not reimbursed. Documented charges incurred by Pro Stage Bikini because of a return may be deducted only where legally permitted.
Sealed hygiene-sensitive products cannot be returned after the protective seal has been opened if applicable law permits that exclusion.
13 Defects and incorrect delivery
The customer must inspect the product after delivery and report a suspected defect or incorrect item without undue delay to info@prostagebikini.ch. The report should include the order number, a clear description and photographs. The customer must not alter, repair, wash or wear the product beyond a careful fitting before Pro Stage Bikini has assessed the issue.
If Pro Stage Bikini is responsible for a defect or incorrect delivery, Pro Stage Bikini will provide the remedy required by applicable law. Depending on the circumstances, this may be repair, alteration, replacement, price reduction or refund. Pro Stage Bikini pays reasonable return shipping costs for a confirmed defect or incorrect delivery.
Fit issues caused by inaccurate measurements, failure to follow measuring instructions, a later body change, a changed preference or use in a different category are not defects. Pro Stage Bikini may offer a paid alteration where possible.
14 Care and use
The customer must follow the care instructions supplied with the product. Competition suits with crystals must be washed and dried only as instructed. Damage caused by machine washing, tumble drying, wringing, heat, a hairdryer, a radiator, harsh chemicals, improper storage, excessive stretching or alteration by a third party is not a product defect.
15 Retention of title
Products remain the property of Pro Stage Bikini until the full amount due for the relevant order has been paid.
16 Intellectual property
Product designs, photographs, text, graphics, crystal layouts and other website or consultation content are protected by intellectual property law. They may not be reproduced, commercially used, supplied to another maker or published as the customer’s own work without prior written permission.
17 Liability
Pro Stage Bikini is liable under the applicable statutory rules for intent, gross negligence, personal injury and any liability that cannot legally be excluded. For slight negligence, liability is limited, where legally permitted, to foreseeable direct loss arising from a material contractual obligation.
Pro Stage Bikini is not responsible for indirect or consequential loss, lost competition opportunities, judging outcomes or losses caused by incorrect customer information, improper use, third-party alterations, customs delays or events outside reasonable control, except where mandatory law provides otherwise.
18 Events outside reasonable control
Neither party is liable for delay caused by events outside reasonable control, including transport disruption, customs measures, natural events, war, strikes, major supplier interruption or official restrictions. Pro Stage Bikini will inform the customer of a material delay and provide a revised estimate. Mandatory rights relating to excessive delay remain unaffected.
19 Data protection and communication
Personal data is processed according to the Privacy Policy published on the website. Order-related messages may be sent by email and, where the customer has provided the relevant username or number, through Instagram or WhatsApp Business.
The customer must keep contact details current and check messages relating to measurements, approvals, payment and delivery.
20 Applicable law jurisdiction and language
Swiss substantive law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. This choice does not deprive a consumer of mandatory protections that apply in the consumer’s country of habitual residence.
Subject to mandatory consumer jurisdiction, the courts at the registered office of Pro Stage Bikini in Basel-Landschaft, Switzerland, have jurisdiction. A consumer may also bring a claim in any court available under mandatory law.
The English and German versions are intended to have the same meaning. If an inconsistency remains, the German version prevails to the extent permitted by mandatory law.
21 Final provisions
The version accepted when the order is submitted applies to that order. Product-specific terms in the written order confirmation take precedence over these general terms if they expressly state a different arrangement.
If one provision is invalid or unenforceable, the remaining provisions continue to apply. The invalid provision will be replaced only to the extent permitted by the applicable law.
